Site Plan Approval is an essential component of the development review process and is intended to complement the objectives of the Official Plan and the requirements of the zoning by-law.
Township of Clearview Site Plan Control By-Law 07-17 designates the lands within its municipal boundaries as being subject to site plan control in accordance with a series of land use designations. The application of site plan control is further outlined in procedural policies that outline in more detail the site plan approval requirements for different types of applications.
The implementation of site plan approval enables the Township to ensure that all new developments will be designed in accordance with the guidelines set out by municipal, regional and provincial authorities. Under the Planning Act, the public is not involved in the site plan approval process.
If it is determined that site plan approval is required, the applicant must complete and submit a formal site plan application. Applications are to be submitted to the Planning and Development Department along with corresponding grading, drainage plans, etc. Upon receiving a site plan application, the Township will review the application to ensure that all required information is included. The application is then forwarded to the Township's engineer and other departments for their review and comment. These departments may include the following:
- Public Works; - Building; - Fire and Emergency Services; - Administration.
The plans and reports may also be circulated to other agencies involved in the site plan process such as the County of Simcoe and the Nottawasaga Valley Conservation Authority (NVCA).
Upon receiving the comments from the engineer, departments and/or agencies, the planner assigned to the file will notify the applicant of any outstanding concerns. Where appropriate, the applicant will be expected to revise the plans accordingly. Once the revisions have been completed, the applicant will resubmit the drawings for further review.
The Planning and Development Department, once satisfied that all drawings and reports are acceptable, shall prepare and provide to the applicant a copy of the draft site plan agreement to be reviewed by the applicant. The applicant shall then be provided with final copies of the site plan agreement for execution. Upon receiving an executed site plan agreement and the required securities, final site plan approval will be granted and a building permit may then be issued. If applicable, the site plan agreement will be registered on the title by our Township's solicitor.
As of January 28, 2008 and as set out in By-law 08-06, prior to the submission of an application for an amendment to the municipality's official plan or zoning by-law, an application for approval of a plan of subdivision or condominium, and an application for site plan approval, the applicant shall attend a pre-consultation meeting with municipal staff.
Failure to fulfill the requirement to attend a pre-consultation meeting shall result in the municipality refusing to accept the application.
Pre-consultation meetings shall be subject to a fee as set out in the municipal Planning Fees By-law as amended from time to time.
