 "Consent" is a term used to describe the municipal approval required to subdivide land without the requirement of a plan of subdivision.
The creation of more than two lots from any one parcel of land will normally only be permitted by plan of subdivision.
Consent is used primarily to sever an existing lot or parcel into more than one lot. It may also be used to add lands to an existing lot, alter lot boundaries, or to obtain approval for long-term leases of lands. An application must be completed and submitted for consideration by the Township.
It is important to ensure the division of land receives municipal approval as it has potential of creating a long term, negative impact on our community. For example, it could result in the misappropriate use of municipal services, such as snow plowing, school busing and garbage collection. In addition, division of land without municipal approval may subject the environment to negative impacts. One example may be that a lot size is too small to maintain an adequate sewage disposal system.
The consent provisional approval process typically takes between one and a half to three months from submission of the application to a decision by the Committee. The length of time required often relates to the complexity of the application, the nature of any related applications, and issues which may arise during review and processing of the application. Following the decision, the consent is also subject to appeal the Ontario Municipal Board for a twenty-day period from the notice of decision.
Once consent has been given, the new land parcel(s) may be sold or resold without further approval. The only exception is if the Township specified otherwise at the time of approval.
Consents on agricultural lands, other than for agriculural uses, are not permitted. Consents on environmental lands are discouraged and require the preparation of an Environmental Impact Study prior to any consideration for approval.
